Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been sentenced to three years in prison without the option of a fine over a KSh1.35 billion land fraud case involving businessman Ashok Rupshi Shah.

Chief Magistrate Dolphina Alego handed down the sentence on Monday, November 2, 2026, after Chelogoi was found guilty on five counts on October 16.

Chelogoi had remained in custody pending sentencing after the court cancelled his bond following the conviction.

The case centres on a 7.39 hectare parcel of land in Lower Kabete, Nairobi, valued at approximately KSh1.35 billion. The property is claimed by businessmen Ashok Rupshi Shah and Hitenkumar Amritlal Raja, who told the court they purchased it from Lima Company Limited in 2007.

Chelogoi was convicted of conspiracy to defraud, forcible detainer, two counts of forgery and uttering a forged document.

In its judgment, the court found that documents used to support his claim to the property were forged, including a letter of allotment allegedly issued in 1995 and documents bearing a land registrar’s signature and stamp.

Chelogoi had maintained that former President Daniel arap Moi allocated him the land in 1995, but the court found that he had failed to provide sufficient authenticated documentation to support his claim.

The prosecution called 19 witnesses, including land officials, surveyors and forensic document examiners, during the trial.

His co-accused, former Assistant Deputy Director of Lands Administration Andrew Aseri Kirungu, was acquitted after the court found that the prosecution had not established his criminal culpability beyond reasonable doubt.

The court also directed the Chief Land Registrar to cancel parallel title deeds and registration details issued over the disputed property, affirming the ownership of Shah and Raja.
