City lawyer Alphonce Collins Odoyo Osewe has been charged in Milimani Law Court in connection with an alleged KSh61 million gold fraud after he was arrested by officers from the Directorate of Criminal Investigations (DCI) within court premises.
Osewe was arrested on Tuesday August 4, 2026 while representing Mukurwe-ini MP John Kaguchia in a separate court matter.
His arrest follows months of unsuccessful attempts by investigators to have him appear before court to answer to fraud-related charges.
According to court documents, Osewe and his co-accused, Patroba Odhiambo Tobias, are accused of obtaining money from two complainants by falsely claiming they could facilitate the sale of 400 kilograms of gold bars.
The prosecution alleges that in May 2023, the suspects fraudulently obtained USD 260,400 (approximately KSh35.7 million) from Bernard Shiaundu Aete after representing that they were in a position to supply the gold.

Osewe also faces a separate count of allegedly obtaining KSh26.1 million from Adeyeye Enitan Ogunwusi under the same purported transaction. The total amount involved in the case is approximately KSh61 million.
The case first came before the courts in October 2025, when Osewe’s co-accused took plea and denied the charges. Osewe failed to appear, with his lawyers informing the court that he had been admitted to hospital and was expected to travel abroad for specialized treatment.
Chief Magistrate Lucas Onyina directed investigators to serve Osewe with summons and ordered him to appear in court to take plea.
The court later scheduled 17 November 2025 for his appearance, but prosecutors maintained that he had not complied with the court’s directions.
His arrest this week clears the way for plea-taking and further court proceedings in the case.
The prosecution maintains that the money was obtained through false pretences, allegations that Osewe is expected to answer before the court. He remains presumed innocent unless and until proven guilty.
